The rapid integration of AI capabilities into wearable technology—from smartwatches to AR glasses and body-worn cameras—has created a significant privacy paradox. While users of these devices may accept terms of service agreements, the people around them have no mechanism to provide informed consent for being recorded, photographed or analysed by increasingly sophisticated AI systems.

These wearables can now capture audio conversations, identify individuals through facial recognition, and interpret contextual information about their surroundings in real time. The data collection occurs passively and continuously, affecting family members, colleagues, strangers in public spaces, and anyone within the device's sensor range. For India and other South Asian nations with large urban populations and dense social networks, the implications are particularly acute.

The privacy challenge extends beyond traditional data protection frameworks. Existing regulations in India, including the Information Technology Rules and emerging digital privacy standards, were largely designed to govern data collection by organisations, not personal devices worn by individuals. Legal experts note that current consent models fail to address scenarios where bystanders inadvertently become subjects of AI analysis without knowledge or agreement.

Industry observers suggest that technology companies developing these devices face mounting pressure to implement privacy-protective measures, such as transparent notification systems, on-device processing to limit data transmission, and user controls that respect bystander rights. However, enforcement remains fragmented across different jurisdictions in South and Southeast Asia, leaving consumers and affected parties in a regulatory grey zone.
