The Allahabad High Court's Division Bench, comprising Justices Abdul Moin and Pramod Kumar Srivastava, on Thursday delivered its order on an appeal stemming from an incident that occurred in Sultanpur district on September 28, 1980. The Bench found that the two convicts in the case were minors when the alleged offence took place, thereby necessitating a reconsideration of the matter under juvenile justice provisions.
The discovery that the accused were juveniles at the time of the incident has significant legal implications, as Indian law provides distinct procedures and protections for minors involved in criminal cases. The High Court's determination has resulted in the matter being remitted to the competent Juvenile Justice Board for appropriate action as per the applicable legal framework.
The remission of the case represents a substantial development in the nearly five-decade-old legal proceedings. The Juvenile Justice Board will now examine the matter afresh, taking into account the statutory provisions governing the treatment of juveniles in conflict with the law. This move underscores the judiciary's commitment to ensuring that procedural safeguards intended to protect minors are properly applied, even in cases dating back several decades.
