Asset Recovery Doesn't End Mallya Money Laundering Case: ED

India's Enforcement Directorate has clarified that the recovery of over Rs 14,000 crore in assets linked to fugitive businessman Vijay Mallya does not constitute a settlement of money laundering charges against him. The agency emphasized that legal proceedings against Mallya remain active despite the asset handover to banks.

The Enforcement Directorate (ED) has underscored that the transfer of movable and immovable properties valued at Rs 14,131.6 crore to an SBI-led banking consortium does not invalidate or lead to the withdrawal of money laundering allegations against Vijay Mallya, the embattled liquor baron and former airline chief.

In a statement clarifying its position, the ED stressed that asset recovery and criminal prosecution are separate legal processes. The agency said the substantial asset handover to creditor banks represents a resolution of civil recovery matters but carries no bearing on the criminal charges filed under the Prevention of Money Laundering Act (PMLA).

Mallya, who fled India in March 2016 amid mounting financial pressures on his Kingfisher Airlines, continues to face serious allegations of money laundering. The ED initiated investigations into alleged fund diversions and suspicious financial transactions linked to the now-defunct carrier and Mallya's business empire.

The recovery of assets—comprising real estate, movable property, and other holdings—represents a significant development in efforts to compensate creditors owed billions of rupees. However, the ED's clarification indicates that Mallya's legal troubles extend beyond financial restitution, with criminal prosecution continuing independently.

Mallya remains based abroad and has resisted extradition efforts by Indian authorities. The ED's statement signals that resolving outstanding dues to banks and financial institutions will not serve as an exit from criminal investigations or potential prosecution related to alleged money laundering activities.
