Bombay HC weighs protester credentials against detention concerns

A division bench comprising Chief Justice Mahesh Chandra Tripathi and Justice Advait Sethna on Monday observed that while peaceful assembly remains a constitutional right, courts must balance multiple factors before issuing blanket restrictions on police operations. The bench directed the Maharashtra government to file replies to public interest litigation challenging the alleged unlawful detention of individuals during demonstrations against the Chief Election Commissioner held in Mumbai.

The court heard arguments in a petition filed by advocate Savar Devre, who raised concerns about police action against participants in solidarity protests linked to demonstrations in Delhi. The plea sought judicial intervention to prevent police from detaining persons engaged in peaceful demonstrations.

During Monday's proceedings, advocate Gayatri Singh submitted an application on behalf of four individuals detained by police following their participation in a peaceful protest last week. The case highlights the continuing tension between law enforcement operations and citizens' rights to demonstrate, with the court now poised to examine the circumstances surrounding the detentions and the conduct of both authorities and demonstrators.
