Cabinet to challenge High Court verdict on SC/ST reservation law

The Cabinet has authorized the filing of an appeal before the apex court following a High Court judgment that struck down a law aimed at extending reservation quotas for SC and ST communities beyond the constitutionally mandated limit of 50 percent.

The High Court had ruled that the legislation, which sought to circumvent the longstanding constitutional ceiling on reservations established through judicial precedent, was unconstitutional. The court's decision effectively invalidated the attempt to provide enhanced reservation benefits to these historically disadvantaged communities.

By moving to appeal the High Court's decision, the government is challenging the judgment and seeking to overturn the verdict in the higher forum. The Supreme Court will now have the authority to review both the constitutional validity of the legislation and the High Court's reasoning in striking down the measure.

The move reflects the government's commitment to pursuing its legislative agenda on reservation policy, which remains a sensitive and contentious issue in Indian politics. The case will likely reignite broader debates over the appropriate scope of affirmative action policies and the balance between constitutional protections and legislative intent in addressing historical inequities.
