The Centre's law officer has orally conveyed to the High Court an intention to challenge a Division Bench judgment that struck down the National Security Act (NSA) detention of student activist Akriti Chaudhary, according to court proceedings.
The High Court had quashed the detention order on September 2, delivering a sharp rebuke to the concerned administrator for failing to apply due diligence while processing a police report against the student. The court's judgment highlighted procedural lapses in the administrative review that had upheld the NSA detention.
Chaudhary had spent nearly five months in custody under the NSA, a stringent preventive detention law that allows authorities to hold individuals without immediate judicial scrutiny. The High Court's intervention led to her release and the cancellation of the detention order.
The Solicitor General's indication to challenge the ruling signals the Centre's bid to defend the original detention decision. The matter now stands to be formally appealed, setting up a potential legal battle over the application of the NSA and administrative compliance with judicial oversight standards in such cases.
