The co-conveners of the Cockroach Janta Party withdrew their plea on Wednesday during a hearing before Justice Subramonium Prasad at the Delhi High Court. The court had convened an urgent session to hear the petition despite the Dussehra recess.
Das and Ranka had challenged an October 19 order by a Special Executive Magistrate that remanded them to two days of judicial custody. Counsel for the CJP leaders approached the high court seeking to contest the magistrate's decision.
Justice Prasad advised the petitioners to first await the outcome of the hearing scheduled before the Special Executive Magistrate on the same day. The judge suggested they could approach the appellate court if their grievance persisted after that hearing. The court clarified that it was permitting the withdrawal without making any observations on the merit of the case.
During the proceedings, the bench orally observed that a petition under Article 226 of the Constitution was not an appropriate remedy for challenging the magistrate's custodial remand order.
