Court clears PN in judicial review challenge against JPPM

The High Court has granted Perikatan Nasional's judicial review application challenging a decision by the Election Commission, though the court stopped short of ordering an interim stay on the party's operational suspension.

The ruling represents a partial victory for the opposition coalition, which had sought to overturn the electoral authority's action through the courts. However, the court's refusal to grant a temporary suspension of the activity freeze means PN remains unable to conduct normal party operations pending the full judicial review proceedings.

The case centres on the Election Commission's decision to suspend PN's activities, a move the coalition contested as exceeding the commission's authority. PN argued that the suspension violated the party's constitutional rights and administrative procedures.

The High Court's decision to approve the judicial review while rejecting the interim relief application suggests the court believes the case has sufficient merit to warrant full examination, but that immediate intervention is not warranted at this stage.

The development comes as PN continues efforts to challenge what it characterizes as overreach by the election authority. The party is expected to pursue further legal remedies as the judicial review process continues through the court system.
