A court has declined to grant a stay of execution on a suspension notice while allowing the applicant to proceed with a judicial review challenge. The suspension notice issued on 22 September remains in effect pending the outcome of the legal proceedings.

The court's decision to deny the stay application while granting leave for judicial review means the suspension will continue to be enforced unless the judicial review succeeds in overturning it. PN had sought to halt the implementation of the suspension pending the outcome of its challenge to the decision's legality. The judicial review leave signals that the court found sufficient grounds to examine whether proper procedures were followed in issuing the suspension notice. The merits of PN's substantive challenge will be determined in subsequent judicial review proceedings. This development represents a significant procedural hurdle for PN, which must now pursue its challenge on the substantive grounds while operating under the active suspension.
