Courts can rule on proclamation disputes, says Negeri Sembilan MB

The legitimacy of a proclamation depends on whether it is grounded in constitutional power and whether proper legal procedures have been followed, according to Negeri Sembilan Menteri Besar Ismail Lasim.

Lasim said that disputes over proclamations fall within the jurisdiction of the courts to determine their validity. The judicial system, he indicated, would examine whether such declarations meet the required legal standards and procedural requirements necessary for establishing state government.

The Menteri Besar emphasised that any proclamation must derive its authority from the state constitution and comply with the stipulated conditions and processes set out in the relevant legislation governing the formation and operation of the state administration.

His remarks underscore the constitutional framework in which executive actions by state governments operate in Malaysia, where judicial oversight serves as a check on the exercise of governmental power at the state level.
