Courts must balance environment protection with development needs: CJI Kant

Speaking at a Commonwealth Policy Dialogue on Climate Justice in London, CJI Kant stressed that courts have a critical role in navigating the complex intersection of environmental conservation and developmental aspirations. The Chief Justice noted that both imperatives can be pursued simultaneously through thoughtful judicial intervention, rather than treating them as opposing forces where one must necessarily prevail over the other.

Addressing delegates at the event, organised by the Commonwealth of Nations and the Commonwealth Legal Education Association at the Commonwealth Secretariat, CJI Kant highlighted the unprecedented scale and cross-border nature of contemporary climate challenges. He observed that climate change impacts are now measured in gigatonnes of carbon emissions and disrupt global supply chains in ways that transcend historical precedent, fundamentally altering the operating environment for legal systems worldwide.

The Chief Justice underscored that the escalating climate crisis will test the boundaries of established legal categories and frameworks. He emphasized that judges and judicial institutions must adapt their approach to address these novel challenges, recognizing that traditional legal constructs may require reimagining in light of environmental realities.

CJI Kant is currently on an official visit to Germany and the United Kingdom, during which he is engaging with Commonwealth legal bodies and policymakers on matters of global significance.
