Delhi court acquits UK national of flag insult charge, frames UAPA charges

The court's decision marks a partial vindication for the accused, who was cleared of charges pertaining to insulting the national flag. However, judicial proceedings against him will continue on more serious grounds related to alleged anti-national activities.

According to court findings, the UK national faced accusations stemming from his presence at a demonstration in London where pro-Khalistan slogans were reportedly raised. The Unlawful Activities (Prevention) Act, under which charges have now been framed, carries provisions for prosecuting individuals linked to activities deemed prejudicial to national security and sovereignty.

The distinction drawn by the court between the two sets of charges reflects differing assessments of the severity of the allegations. While the flag insult charge could not be substantiated to the required legal standard, the court found sufficient grounds to proceed with UAPA charges based on evidence of the accused's alleged involvement in the London protest.

The case highlights the Indian judicial system's approach to handling overseas activities of citizens and foreign nationals that are perceived to threaten national interests. The accused now faces the prospect of a full trial under provisions that entail stringent penalties if conviction is secured.
