Delhi HC directs probe into fake GST registrations via PAN, Aadhaar
The Delhi High Court has sought immediate steps to curb fraudulent GST registrations obtained using legitimate PAN and Aadhaar credentials. The court has suggested implementing facial recognition, video verification, and real-time monitoring systems to prevent misuse.

The Delhi High Court has directed authorities to address the mounting problem of fraudulent GST registrations being obtained through stolen or misused PAN and Aadhaar details. The court expressed concern over the ease with which criminals are able to register businesses for tax purposes using legitimate identification credentials belonging to unsuspecting citizens.
During recent proceedings, the court suggested a multi-layered approach to plug security gaps in the GST registration process. The bench recommended implementing facial recognition technology to verify applicants, coupled with video-based identity confirmation at the point of registration. These measures would add an additional layer of authentication beyond the current document submission process.
The court also proposed establishing real-time alert mechanisms that would immediately notify PAN and Aadhaar holders whenever their credentials are used to file GST applications. Such notifications would enable genuine cardholders to flag fraudulent attempts at the earliest opportunity.
The GST Network and tax authorities have been directed to examine the feasibility of these safeguards and present an implementation roadmap. The court noted that while digital identity documents have streamlined business registration, the absence of robust verification protocols has created vulnerabilities that fraudsters are actively exploiting.
This directive comes as tax authorities grapple with an increasing number of shell companies being registered using legitimate credentials of individuals unaware their identities are being misused. Officials acknowledged that enhancing verification procedures would require coordination between the GST system, Aadhaar authorities, and the tax department.
