The Delhi High Court has issued a notice to Beco, seeking its response to a disparagement suit filed by Hindustan Unilever Limited (HUL) over an advertising campaign. HUL contends that Beco's marketing materials made misleading claims about its own products by linking chemicals present in HUL's Surf Excel laundry detergent and Vim dishwashing liquid to skin irritation and allergic reactions.
The consumer goods major alleged that Beco's campaign was designed to damage the reputation and commercial interests of its well-established cleaning products through comparative advertising that lacked substantiation. HUL argued that the claims were deceptive and intended to mislead consumers about the safety and quality of its products.
The court has directed Beco to file its response, with the matter now pending judicial review. Disparagement cases in the Indian consumer goods sector have become increasingly common as brands compete aggressively for market share. The case will test the boundaries of permissible comparative advertising under Indian law and consumer protection frameworks.
The outcome could set precedent for how companies market products by making claims about competitors' ingredients and safety standards. Both companies operate in the highly competitive household cleaning products segment, where brand trust and product safety perception play crucial roles in consumer purchasing decisions.
