Delhi High Court seeks government response on Fortune soyabean oil product claims

The Delhi High Court has sought the response of the Centre and the Food Safety and Standards Authority of India (FSSAI) to a petition filed by Fortune Brand challenging action taken against the company's soyabean refined oil product.

The company has challenged regulatory measures related to two specific claims made on the product packaging: "100% Veg" and "Cholesterol Free – For Healthy Lifestyle." The FSSAI had taken action against these claims, which Fortune Brand contends are accurate and permissible under existing regulations.

The case centres on whether the labelling descriptions comply with food safety standards and advertising guidelines. Fortune Brand's petition argues that the claims are substantiated and should be permitted on the packaging of the product sold to Indian consumers.

The High Court's directive for a response from the FSSAI and the Centre will provide an opportunity for both parties to present their positions on the labelling dispute. The regulatory authority will need to justify its action against the specific claims, while the company will have the chance to defend the accuracy and legality of its product descriptions under current food safety regulations.
