The Delhi High Court has issued a notice to the Delhi Police seeking their response to a petition filed by the Indian Youth Congress (IYC) challenging the rejection of permission to hold a protest against the Chief Election Commissioner (CEC).
In its petition, the IYC contended that the police denial was made on mechanical grounds without proper consideration and amounted to a violation of its fundamental rights, particularly the right to equality and freedom of assembly guaranteed under the Constitution.
The youth wing of the Indian National Congress had sought permission to organize a demonstration to voice concerns related to electoral matters but faced rejection from the authorities. The petitioners argue that the blanket rejection of their request was arbitrary and did not follow established procedures for evaluating protest applications.
The case raises questions about the administrative process governing protest permits in the capital and the balance between maintaining public order and protecting citizens' constitutional rights to peaceful demonstration. The high court's directive to the police to respond substantively to the IYC's contentions suggests the bench will examine whether proper grounds existed for the denial.
The Delhi Police's response is now awaited, which will detail the reasons behind the rejection and the considerations that led to the decision. The court will subsequently hear arguments from both sides before determining whether the IYC's fundamental rights were indeed violated by the permit denial.
