Delhi mall shopkeepers wait over a decade for possession after full payment

A major controversy has erupted at MetroFlex East mall in East Delhi, with shop owners accusing developers of systematic violations of approved building designs and repeated failures to deliver promised retail spaces.

According to shop owners, the mall's approved blueprint sanctioned approximately 110 retail units. However, developers allegedly constructed nearly 245 shops on the premises, more than double the sanctioned number. This expansion occurred without obtaining proper approvals or informing buyers, traders claim.

The situation has left hundreds of shopkeepers in legal limbo. Many merchants paid their full investment amounts over a decade ago, with some completing payments as early as 2011. Yet despite the passage of more than 12 years, they remain unable to obtain either possession of their commercial spaces or complete property registration.

The delayed possession has forced affected traders to navigate an uncertain business landscape, unable to occupy their shops or legally establish their commercial enterprises. The case highlights ongoing concerns regarding developer accountability and buyer protection in Delhi's commercial real estate sector, where regulatory oversight of construction projects and adherence to approved plans remains inconsistent.

The dispute underscores the vulnerability of small business owners in India's commercial property market and raises questions about enforcement mechanisms to ensure developers comply with building approvals and meet their contractual obligations to buyers.
