The Maharashtra Real Estate Regulatory Authority (MahaRERA) has ruled that developers cannot unilaterally transfer stamp duty responsibilities to property buyers, reinforcing consumer protections in real estate transactions across the state.
The ruling establishes that stamp duty costs, which are the legal obligation of property sellers, cannot be passed on to purchasers as an additional burden. This clarification addresses a common practice where some developers have attempted to recover stamp duty expenses from buyers, effectively increasing the effective purchase price beyond the quoted rate.
