Fixed-term contract expiry not unfair dismissal, court rules

The Industrial Court has dismissed a former HR manager's bid to be reinstated to her position and receive outstanding salaries and other benefits from her previous employer, determining that the natural conclusion of a fixed-term contract does not amount to unfair dismissal.

The court's decision underscores the legal distinction between the termination of an employment contract and the expiration of a fixed-term arrangement. Under Malaysian employment law, when a fixed-term contract reaches its end date without renewal, the employment relationship concludes by operation of law rather than through an act of dismissal by the employer.

The ruling clarifies that employees engaged on fixed-term contracts do not have the same statutory protections against dismissal as those employed on indefinite terms. Fixed-term arrangements are conditional agreements where both parties understand that the employment will end on a specified date unless extended.

The decision carries implications for employers and workers across Malaysia's private sector, where fixed-term contracts remain a common employment arrangement. The court's judgment reinforces that employers are not obligated to renew such contracts or provide severance benefits upon their expiration, provided the contract terms are fulfilled.
