The Gauhati High Court has invalidated the National Security Act (NSA) detention order against Pranab Doley, an environmental activist from Assam who was protesting against a proposed luxury hotel project in the vicinity of Kaziranga National Park.
Assam's State government invoked the stringent NSA against Doley on July 30, merely 24 hours after a lower court granted him bail in connection with his demonstrations against the hotel development. The timing of the detention order—immediately following his release on bail—raised questions about the administration's approach to managing dissent.
The NSA, a preventive detention law that allows authorities to hold individuals without formal charges for extended periods, is typically invoked in cases deemed to pose a threat to public order or national security. Doley's case centred on his activism concerning environmental protection and the sanctity of the wildlife sanctuary.
The High Court's decision to quash the NSA detention order represents a significant development in balancing civil liberties with governmental powers of detention. The ruling underscores judicial scrutiny of preventive detention orders, particularly when invoked against individuals engaged in lawful protest and activism.
Kaziranga National Park, a UNESCO World Heritage Site located in Assam, is home to the world's largest population of Indian rhinoceros and remains central to conservation efforts in the Northeast region.
