Government seeks Supreme Court guidance on contested budget projects
The Office of the Solicitor General has petitioned the Supreme Court to clarify which infrastructure and development initiatives funded through unprogrammed appropriations may proceed after the high court ruled such spending unconstitutional. The filing seeks to resolve uncertainty affecting projects under the 2024 and 2025 national budgets.

The Office of the Solicitor General submitted an 85-page motion for clarification and partial reconsideration on November 4, asking the Supreme Court to provide specific guidance on project implementation following its decision striking down unprogrammed appropriations as unconstitutional.
The motion addresses ambiguity created by the Court's ruling, which left unclear which ongoing and planned projects could legally continue under existing budget allocations. Government lawyers argue that explicit clarification is necessary to prevent disruption to critical initiatives and to guide agencies in determining project status going forward.
Unprogrammed appropriations, which allow government to fund projects not specifically itemized in the original budget law, have long been used to finance infrastructure, social programs, and emergency spending. The Supreme Court's constitutional challenge has raised questions about the legality of numerous projects across multiple agencies under both the 2024 and 2025 budgets.
The OSG's filing represents the government's formal effort to work within the Court's constitutional framework while preserving implementation capacity for priority projects. The motion seeks to balance fiscal accountability with practical governance concerns, though the timing and scope of any Court response remains uncertain.
