The Insolvency and Bankruptcy Board of India (IBBI) has issued guidelines requiring Insolvency Professionals (IPs) to conduct enhanced due diligence and report instances of potential abuse within the Insolvency and Bankruptcy Code (IBC) framework.

The directive represents a tightening of oversight mechanisms as the regulator intensifies efforts to preserve the integrity of India's debt resolution system. The move follows a series of disciplinary actions against administrators found to be non-compliant with IBC provisions and professional standards.

Insolvency Professionals, who serve as key functionaries in managing corporate insolvencies and liquidations, are now expected to identify and flag suspicious activities that may constitute misuse of the framework. The enhanced scrutiny aims to prevent the IBC mechanism—introduced in 2016 to streamline corporate debt resolution—from being exploited by parties seeking to circumvent legitimate creditor interests or manipulate proceedings.

The IBBI's initiative underscores growing concerns about compliance gaps within the insolvency profession as the system has matured. By placing gatekeeping responsibilities on IPs themselves, the regulator seeks to create a self-policing mechanism that complements its own enforcement efforts.
