IBBI tightens safeguards for personal guarantor insolvency proceedings
India's insolvency regulator has proposed sweeping reforms to strengthen protections in resolution processes involving personal guarantors to corporate debtors, including mandatory asset valuations and restrictions on related-party voting.

The Insolvency and Bankruptcy Board of India (IBBI) has unveiled a series of regulatory changes designed to enhance safeguards in insolvency resolution proceedings for individuals who have guaranteed corporate debts, marking a significant tightening of oversight in a contentious area of insolvency law.
Under the proposed amendments, related parties of personal guarantors would be barred from voting on repayment plans negotiated during insolvency proceedings. The regulator has also mandated that asset valuations of personal guarantors become a compulsory component of the resolution process, ensuring creditors have accurate information when evaluating recovery prospects.
The IBBI's proposals additionally require a formal framework for documenting creditor discussions and deliberations surrounding repayment plans. Critically, the watchdog has called for systematic identification and reporting of avoidance transactions—including preferential transfers, undervalued transactions, fraudulent dealings, and extortionate credit arrangements—within personal guarantor insolvency cases.
These regulatory interventions reflect growing concerns about the adequacy of protections in personal guarantor resolution processes, where creditors' interests have sometimes been subordinated through settlements offering minimal recovery prospects. The enhanced framework aims to ensure greater transparency, fairness, and accountability throughout the resolution lifecycle, strengthening confidence in India's insolvency system among lenders and other stakeholders.
