Immigration cannot take action against UNHCR card-holding Rohingya

Rohingya refugees in Malaysia who possess valid United Nations High Commissioner for Refugees (UNHCR) cards are not subject to immigration enforcement action, authorities clarified on Monday.

Cardholders are not classified as illegal immigrants under Malaysian law and therefore cannot be charged with overstaying or operating without proper travel documentation and valid passes, according to immigration officials.

The UNHCR card serves as official recognition of refugee status and provides legal protection to holders in Malaysia, where the country hosts one of the largest refugee populations in Southeast Asia. The documentation exempts cardholders from standard immigration violations that typically apply to undocumented migrants.

The clarification comes as Malaysia continues to manage its refugee situation, with thousands of Rohingya fleeing persecution in Myanmar. The UNHCR maintains a registration database of refugees in Malaysia and issues the identity cards as part of its mandate to protect vulnerable populations.

Malaysian immigration authorities have emphasized the importance of distinguishing between registered refugees holding valid UNHCR documentation and undocumented migrants, as the two categories are subject to different legal frameworks and enforcement procedures.
