India Patent Office Cracks Down on Unauthorised Logo Use

The Office of the Controller General of Patents, Designs and Trade Marks (CGPDTM) has warned that no entity can replicate or display the official emblem of the Indian Patent Office without prior clearance from the Ministry of Commerce and Industry. The directive applies to individuals, corporate bodies, digital platforms, trademark agents, patent practitioners, and legal service providers engaging in such unauthorised use. The logo serves as an official government identifier representing the statutory authority under the Department for Promotion of Industry and Internal Trade. Violations have prompted the current enforcement action as the government seeks to protect the integrity of its intellectual property office branding. The CGPDTM noted that various unauthorised service providers have been misusing the official logo on websites, social media accounts, marketing collateral, stationery, and paid digital advertisements to create false associations with the legitimate patent office. The ministry's notice underscores the legal protections afforded to government symbols and the consequences of their unauthorised commercial or promotional use. Companies and practitioners seeking to reference or display patent office credentials must now seek explicit written approval from the Ministry of Commerce and Industry to remain compliant with government directives.
