Credit card holders in India can challenge disputed or unauthorised charges through several established mechanisms, regulatory authorities have clarified. The process begins with immediate notification to the card issuer upon discovering questionable transactions, a critical step that initiates formal dispute resolution procedures and protects consumers' legal standing.
According to guidelines set by the Reserve Bank of India and banking ombudsman provisions, consumers must report unauthorised transactions at the earliest opportunity. Financial institutions are required to acknowledge dispute complaints within specified timeframes and conduct investigations into the contested charges. During this period, card holders should preserve all relevant documentation, including transaction records, merchant communications, and billing statements.
While disputes are under investigation, consumers must continue paying undisputed amounts on their credit card bills to avoid penalties and credit score damage. Failure to maintain minimum payments can complicate dispute resolution and trigger additional charges. The RBI's framework stipulates that banks must conclude investigations and provide findings within defined periods, typically ranging from 30 to 90 days depending on transaction complexity.
If card issuers reject legitimate dispute claims, consumers can escalate matters to the Banking Ombudsman, an independent authority established to address grievances against financial institutions. The ombudsman scheme, operating under central and state-level offices, provides a free and binding dispute resolution mechanism. Consumers can also approach consumer protection authorities or seek legal recourse if necessary, ensuring multiple safeguards exist against fraudulent or erroneous billing practices.
Experts recommend maintaining detailed records of all communications with banks and preserving evidence of disputed transactions. This documentation strengthens consumers' positions during investigations and appeals, ultimately facilitating quicker resolution and liability reversal.
