The Indian Supreme Court made the oral observation on October 6 while hearing arguments in a batch of petitions that contest the constitutional validity of India's transfer of Kachchatheevu island to Sri Lanka. The bench suggested that sensitising Indian Tamil fishermen about the prohibition on entering Sri Lankan territorial waters would be an important step in addressing the ongoing disputes in the region.

Kachchatheevu island, located between the Indian state of Tamil Nadu and Sri Lanka, has long been a flashpoint in bilateral relations, with fishermen from both nations regularly entering disputed waters. The island's sovereignty remains a contentious issue, with Indian petitioners arguing that its cession to Sri Lanka was unconstitutional and violated the rights of local fishing communities.

The court's suggestion reflects ongoing concerns about the welfare of Indian fishermen who venture into Sri Lankan waters, where they risk arrest and detention. The Indian fishing community in Tamil Nadu has repeatedly faced hardship due to apprehensions and legal complications arising from such incursions.
