Industry group urges government to clarify legal status of nicotine vaping

An industry coalition representing vaping manufacturers and retailers has pressed the Malaysian government to provide immediate clarity on the regulatory framework for nicotine-containing e-cigarettes, citing regulatory ambiguity that threatens business operations.
The appeal comes after the government withdrew its appeal against a High Court decision, creating uncertainty over which legislation takes precedence in governing the sector. The industry group has identified overlapping provisions between the Poisons Act and Act 852 as the core issue requiring resolution.
The regulatory conflict has left businesses in limbo regarding compliance requirements and product legality. Industry representatives have warned that prolonged uncertainty could undermine investment and employment in the sector while creating confusion among retailers and consumers about which rules apply.
Government officials have not immediately responded to the industry's request for clarification. The matter highlights broader challenges facing Malaysian regulators in establishing clear, consistent frameworks for emerging consumer products that fall between established legislative categories.
Stakeholders have urged the government to convene consultations with relevant agencies to develop a unified regulatory approach that addresses both public health concerns and industry viability.
