Judiciary and Bar Council to pilot family mediation programme

The Malaysian judiciary and Bar Council are joining forces to introduce a family mediation pilot project designed to alleviate growing case backlogs in the nation's family courts. The initiative will commence next month and operate across High Courts in Kuala Lumpur, Shah Alam, Penang and Johor Bahru, representing a coordinated effort to streamline proceedings in matrimonial and family-related disputes.

Family law cases have long constituted a significant portion of the court system's workload, contributing to delays that can protract personal and financial matters affecting Malaysian families. The mediation programme offers an alternative pathway for disputants to resolve issues outside the traditional adversarial courtroom environment, potentially accelerating case resolution while reducing associated legal costs.

The four participating High Courts have been selected as pilot sites to test the effectiveness of the mediation model before potential expansion to other jurisdictions. Preliminary data from the pilot phase is expected to inform policy decisions regarding nationwide implementation of the programme.

The collaboration between the judiciary and legal profession reflects growing international recognition of mediation's benefits in family law disputes, where preserving relationships—particularly those involving children—often takes precedence over adversarial outcomes. If successful, the pilot could represent a significant shift in how Malaysia's legal system approaches family conflict resolution.
