Kentucky court blocks mental capacity inquiry in widow's inheritance dispute

The Kentucky Court of Appeals determined that Tamara Williams' decision to reject the will of her deceased husband Julian D. Williams and claim her statutory share cannot be subjected to a mental capacity inquiry at the district court level.

The dispute arose when Williams exercised her legal right to reject her husband's will following his death. The late husband's stepchildren contested her choice, arguing that she lacked the requisite mental capacity to make such a significant decision regarding her inheritance.

In its ruling, the appeals court clarified the proper jurisdictional framework for such contested matters. The court determined that cases involving disputes over inheritance decisions and mental capacity claims must be resolved in circuit court, not district court, establishing an important procedural boundary for succession-related litigation.

The decision effectively halts the lower court's inquiry into Williams' mental fitness at the district level, though it does not preclude further proceedings in the appropriate circuit court jurisdiction if the stepchildren choose to pursue the matter through the correct legal venue.
