Kerala court examines juvenile accident law provisions in bail review case

Judge Kavitha Gangadharan of a Kerala court has directed authorities to compile data on invocations of Section 105 of the Bharatiya Nyaya Sanhita (BNS) in accident cases involving juvenile drivers, as part of ongoing proceedings in the Cheranalloor crash matter.

The judicial directive emerges from appeals filed by both the prosecution and the family of the deceased challenging bail granted to a teenager by the Juvenile Justice Board in connection with the fatal accident. The judge's move suggests concerns about whether the legal provision has been consistently and appropriately applied across similar cases.

In a significant warning to the investigating officer, Judge Gangadharan cautioned that accountability would follow if no FIRs invoking Section 105 of the BNS had been registered in comparable cases elsewhere, while the provision was selectively invoked only in the present matter. The order underscores judicial scrutiny over the uniform application of legal frameworks in juvenile-related traffic accident prosecutions.

The data compilation is expected to be appended to the court's order on the competing appeals, providing a broader legal context for the bail decision under review. The case highlights ongoing questions about how juvenile justice provisions intersect with traffic law enforcement in India.
