The Kerala High Court has rejected a plea filed by the accused in the Abhimanyu murder case requesting a stay on trial until the investigation is concluded. The court found insufficient grounds to halt the proceedings on the basis of the pending investigative work.
The accused had sought to suspend all trial-related activities, arguing that the investigation remained incomplete and that proceeding with the case prematurely could prejudice their defence. However, the high court determined that the investigative process and trial proceedings could run concurrently without compromising the integrity of either.
The judgment reinforces the court's position that trial delays cannot be justified merely on the grounds of ongoing investigations, particularly when adequate procedural safeguards exist to protect the rights of the accused. The decision allows the prosecution to continue presenting evidence while investigative agencies proceed with their work independently.
With the plea dismissed, the trial in the Abhimanyu murder case will now proceed according to the scheduled timeline set by the trial court. The accused retains the right to seek other legal remedies if new developments warrant intervention at subsequent stages of the proceedings.
