Kerala seeks NGT exemption from dedicated waste management fund account

The Kerala government has approached the National Green Tribunal (NGT) requesting exemption from establishing a dedicated, ring-fenced account for environmental compensation funds tied to inadequate waste management practices across the state.

The NGT's Principal Bench in New Delhi had earlier issued directions requiring all state authorities to set up a single, centralized account at the state level. This account was intended to serve as a repository for funds earmarked as environmental compensation—financial penalties levied for violations of waste management protocols and environmental regulations.

Ring-fenced accounts are segregated financial arrangements designed to ensure that designated funds are used exclusively for their specified purpose, preventing diversion to other budgetary allocations. The tribunal's directive aimed to create greater accountability and transparency in the management of environmental compensation collected from violators of waste management norms.

The state government's request for exemption suggests administrative or financial concerns regarding the implementation of the centralized account structure. The petition is expected to be reviewed by the tribunal, which will determine whether Kerala warrants special consideration or must comply with the original directive.

This development comes as environmental compliance and waste management continue to be priority areas for regulatory oversight across India, with the NGT playing a pivotal role in enforcing environmental standards and ensuring adequate remediation for environmental damage.
