Legal war, round two: Manila prepares, Beijing warns

In eight days Manila hosts the leaders of Southeast Asia at the 49th ASEAN Summit, and, it is expected, the first Quad leaders' meeting in more than two years. But this weekend the opening moves came from Sanya, on China's Hainan Island. At a South China Sea symposium there, a Philippine analyst said Manila is preparing papers for a possible second legal case against Beijing. The same weekend in Sanya, a Chinese-led report cast China as the keeper of the peace. The question for Asia: is Manila preparing to take China back to court, or is Beijing writing the pre-summit story first?

The case

On Saturday, the South China Morning Post reports, Rommel Banlaoi, president of the Philippine Society for International Security Studies, told the symposium: "Indeed, the Philippines is considering filing another case against China, and authorities are already preparing the necessary legal documentation."

This is an analyst describing preparations, not a filing and not a government announcement. Banlaoi said, "The president must give the green signal to do such a thing." He added that Manila was likely to hold off for now, as ASEAN chair this year, with Code of Conduct talks still under way. Singapore takes the chair next year.

A second case, Banlaoi said, would seek compensation for environmental destruction and economic losses, plus alleged violations of sovereign rights and breaches of the UN Convention on the Law of the Sea. Manila is gathering evidence, he said, but jurisdiction is the primary challenge, and experts are still debating the right forum.

Foreign Secretary Theresa Lazaro has said another case "can be discussed, further discussed and studied," but that no decision has been made, Bilyonaryo News Channel reports. This year is also the tenth anniversary of the 2016 arbitral ruling that invalidated key elements of Beijing's vast claims. China did not take part and does not recognise the verdict.

The forum and the warning

The Sanya maritime symposium drew about 400 representatives from more than 30 countries and regions, CGTN reports. On Saturday it released a Global Maritime Security Report compiled by the Huayang Center. In the preface, the centre's chairman, Wu Shicun, wrote that China and ASEAN have pressed ahead with Code of Conduct consultations and that the South China Sea has remained generally stable and manageable. He listed the challenges as the growing involvement of extra-regional powers, increasing unilateral actions by some claimants, and the continuing repercussions of the so-called arbitral award. Another contributor, Yang Li, noted that China reinforces its claims through baselines and nature reserves.

Our read: Manila is building a legal file. Beijing is building a legal narrative of its own, in which the ruling itself is the problem.

On 3 November the state-run Global Times published a commentary by Qian Feng of Tsinghua University's National Strategy Institute. He wrote that the Quad, "which had been dormant for two years, has finally been dusted off and brought back from the freezer by the US administration." He warned: "If certain countries seek to use a small-circle summit to openly demonstrate their intention to interfere in South China Sea affairs, China will inevitably oppose it resolutely." The Times of India carried that warning on Sunday.

The Quad itself is still mostly a promise. US Secretary of State Marco Rubio said in Atlanta, "We will have a Quad leaders' meeting in Manila," but the Times of India says an official announcement is still awaited. At sea the four are further along: the Malabar exercise opened at Yokosuka on Thursday and runs through 12 November, hunting submarines, with INS Sahyadri and HMAS Stuart among the ships.

The scorecard

Manila is preparing the papers, but as ASEAN chair it may choose to wait. Beijing is hosting the narrative in Sanya and warning the Quad off the South China Sea before it meets. For Washington and the Quad, a meeting is promised, the date is still not official, and ships are already drilling off Japan. ASEAN is the house in which all of this will be staged.

Our verdict: Manila is gathering a legal file while it hosts the region. Beijing is setting the story first, and warning the Quad not to turn the summit into a South China Sea platform. Watch two things: whether President Marcos gives the green signal for a case, after the chair year or sooner, and whether a Manila Quad statement, if one comes, names the South China Sea. If it does, Beijing's warning faces its test. If it does not, Sanya wrote the story first.
