Life convicts can split annual leave into two instalments: Madras HC
The Madras High Court has ruled that prison authorities cannot compel life-sentence prisoners to take their entire 40-day annual leave entitlement in a single block. The decision provides greater flexibility to incarcerated individuals in managing their statutory leave.

The Madras High Court has clarified that life convicts have the right to divide their 40 days of annual leave into two separate instalments rather than taking it in one continuous period. A bench comprising Justices Anita Sumanth and Sunder Mohan issued the directive, holding that prison administrations cannot mandate that leave be availed only once per year.
The ruling stems from a legal challenge to existing prison protocols that restricted convicts' autonomy in deciding how to utilise their entitled leave. The court determined that the statutory leave provision should be interpreted with sufficient flexibility to accommodate individual preferences and circumstances.
This decision marks a significant recognition of prisoners' rights within India's correctional system. By permitting bifurcated leave, the court has acknowledged that periodic breaks can be more meaningful for maintaining family relationships and psychological well-being than a single extended absence from prison.
The judgment applies to life-sentence convicts across Tamil Nadu and serves as precedent for prison administrations to revise existing leave policies. Officials have been directed to implement the new framework, which provides prisoners greater agency in planning personal visits and maintaining family connections while serving their sentences.
