Madras HC quashes ED order but restores complaint against drug smuggler

A division bench of the Madras High Court comprising Chief Justice Sushrut Arvind Dharmadhikari and Justice G. Arul Murugan has intervened in proceedings against drug smuggling accused Jaffer Sadiq, quashing an earlier order that had taken cognisance of an Enforcement Directorate complaint without following due process.

The bench's decision underscores the importance of procedural fairness in criminal proceedings. While the court quashed the original order, it did not dismiss the complaint entirely, recognising the need to balance the rights of the accused with the integrity of the investigation.

The court has mandated that the trial court concerned must grant Jaffer Sadiq a full opportunity to present his defence and raise objections before taking cognisance of the ED complaint. This direction ensures that the accused is afforded a fair hearing in accordance with criminal procedure norms.

The judgment reflects judicial oversight in cases involving financial crimes and drug trafficking, where regulatory agencies like the ED may file complaints. The Madras High Court's intervention emphasizes that cognisance of such complaints cannot be taken summarily, and accused individuals retain their constitutional right to be heard before formal proceedings commence.

The matter now reverts to the trial court, which will proceed in accordance with the high court's directions, allowing Jaffer Sadiq to present his case before any further action is taken in the case.
