Madras High Court closes petition on gold loan regulation

The Madras High Court bench comprising Chief Justice Sushrut Arvind Dharmadhikari and Justice G. Arul Murugan closed proceedings on a public interest petition that sought enhanced regulation of gold loan operations and auctions of mortgaged jewellery. The court's decision came after examining the Reserve Bank of India's position on the matter.

The RBI informed the bench that it had already issued necessary circulars to address concerns related to gold loan transactions and the subsequent auction of pledged items. These guidelines, the central bank submitted, were sufficient to ensure compliance and protect consumer interests in the gold lending sector.

Satisfied with the RBI's regulatory framework, the bench disposed of the petition, concluding that the existing circulars adequately covered the issues raised by the petitioner. The court recorded the central bank's statement as part of its order before closing the case.

The gold loan sector has witnessed significant growth in recent years, particularly in South India, with numerous non-banking financial companies and smaller institutions offering loans against gold jewellery. Regulatory oversight has been a concern for consumer advocates, prompting periodic judicial and administrative review of the sector's practices.
