The Madras High Court on Tuesday rejected a petition that sought to prevent the transfer of five juvenile elephants from Assam to Tamil Nadu, ruling that the petitioner had acted prematurely in approaching the judiciary.
Chief Justice Sushrut Arvind Dharmadhikari and Justice G. Arul Murugan noted that the petitioner had moved the court within 24 hours of submitting a representation to a high-powered committee appointed by the Supreme Court to oversee such matters. The bench observed that the petitioner ought to have allowed the committee sufficient time to examine the representation before seeking judicial intervention.
The committee, constituted to ensure compliance with legal and welfare standards for elephant transfers, is tasked with evaluating such relocations across Indian states. The court's dismissal clears the way for the elephants' transfer to proceed, subject to any further review by the Supreme Court-appointed panel.
The transfer of captive elephants between states requires approval from multiple authorities to ensure animal welfare compliance and adherence to wildlife regulations. The bench's order underscores the importance of exhausting administrative remedies before seeking court intervention in such cases.
