Madras High Court orders reconsideration of bail pleas in SC/ST Act case

Justice G.K. Ilanthiraiyan of the Madras High Court has issued directions to the Erode District Court to revisit and consider the bail pleas of nine individuals facing charges under the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act. The High Court's order came on a Criminal Original Petition filed by the accused persons under Section 528 of the Bharatiya Nagarik Suraksha Sanhita (BNSS), 2023, the new criminal procedure framework that came into effect this year.

The High Court's intervention indicates concerns regarding the procedural handling of the bail applications at the lower court level. By directing the Erode court to reconsider the pleas, the High Court has provided the accused with an opportunity for their bail applications to be reviewed afresh in accordance with legal provisions and established bail jurisprudence.

The SC/ST (Prevention of Atrocities) Act is a stringent law designed to protect members of scheduled castes and scheduled tribes from acts of violence and discrimination. Bail provisions under this legislation are typically more restrictive, requiring courts to examine specific legal thresholds before granting relief to the accused.

The order underscores the judiciary's role in ensuring procedural fairness and adherence to legal norms even in cases involving serious statutory offences. The Erode court is now expected to conduct a fresh hearing on the bail applications with due consideration to the High Court's directive and applicable legal principles.
