The Madras High Court has quashed money laundering proceedings against former DMK minister V. Ponmudy and his son Gowtham Sigamani. A bench comprising Chief Justice Sushrut Arvind Dharmadhikari and Justice G. Arul Murugan delivered the order, finding that continuation of the case lacked legal basis.
The court's decision hinged on the acquittal of the petitioner in the predicate offence—a red sand quarrying case that had formed the foundation of the money laundering allegations. The judges noted that without a conviction in the underlying criminal matter, the money laundering proceedings could not proceed.
The ruling underscores a significant legal principle in Indian jurisprudence: money laundering charges typically require proof of a predicate offence. When the prosecution fails to establish guilt in the original case, connected money laundering investigations lose their foundation.
The case had drawn attention as Ponmudy, a senior DMK figure, faced the dual legal challenge stemming from allegations related to sand quarrying operations in Tamil Nadu. The court's decision now brings both matters to a close for the former minister and his son.
