Malaysia deregisters its opposition bloc: law or lawfare?

Eleven days before nominations open for a state election, Malaysia's registrar has struck the country's main opposition coalition off the books. Perikatan Nasional, the bloc whose biggest member, PAS, holds more seats than any other single party in parliament, no longer exists as a registered coalition. Is this a regulator enforcing the rules, or a reformist government using paperwork against its rivals?

What the registrar decided

On Tuesday, 20 October, the Registrar of Societies, which answers to the Home Ministry, announced it had cancelled Perikatan Nasional's registration under the Societies Act of 1966. The Registrar said the coalition's reply, sent on 12 October, "failed to refute the grounds" set out in a show-cause notice from 22 September. According to the cancellation notice, as reported by Berita Harian and the New Straits Times, the core ground is narrow: the coalition denied one of its own founding members, Bersatu, the right to attend an emergency meeting of its supreme council on 16 July, in breach of its own constitution.

That complaint came from inside the house. Bersatu, the party of former prime minister Muhyiddin Yassin, filed it on 11 August. The Islamist party PAS had ended political cooperation with Bersatu in June, and the two have been fighting over who leads the bloc. PAS now dominates a coalition that also includes Gerakan, Pejuang, Wawasan and the Malaysian Indian People's Party.

Then there is the timing. The show-cause notice landed on the day the dissolution of the Melaka state assembly was announced, and the coalition's activities were suspended the next day. Melaka votes on 14 November, with nominations on 31 October. The cancellation also came two days before a High Court hearing on the coalition's bid to pause that suspension, and the opposition says government lawyers told the court on 19 October that the process was ongoing.

The opposition hits back

Secretary-general Takiyuddin Hassan says the coalition will challenge the order at Thursday's hearing, and it can appeal to the home minister within 30 days. In a statement reported by Reuters, the coalition called the move an attempt to weaken political opponents ahead of the Melaka election. Bersatu sees it the other way. Muhyiddin called the decision "a reminder" to parties that lead coalitions "to act fairly towards component parties". Prime Minister Anwar Ibrahim's party, PKR, denies any role, calling one opposition leader's claim defamatory.

Why does it matter? In practice, less than it sounds. PAS, Bersatu and the smaller parties still exist and can still field candidates. What they lose is the shared logo and the single banner. Malaysia has seen this before. In April 2018, the same registrar provisionally dissolved Bersatu weeks before a general election. That opposition alliance contested under a partner's logo, and won. Symbols can be borrowed. Trust is harder to rebuild.

A regional pattern, and LSN's verdict

The bigger picture is regional. Across Southeast Asia, opposition parties are too often removed not at the ballot box, but by institutions. In August 2024, Thailand's Constitutional Court dissolved Move Forward, the party that won the most seats at the 2023 election, and banned its executives from politics for ten years. In November 2017, Cambodia's Supreme Court dissolved the main opposition, the Cambodia National Rescue Party, and barred 118 of its politicians for five years. Malaysia's case is different in kind: an administrative ruling, triggered by a complaint from a coalition member, not a court case against an opposition idea. But the region reads these signals together.

LSN's analysis, the Unfiltered verdict: on the narrow law, the registrar may well be right. A coalition that locks out a founding member has broken its own rulebook, and the complaint came from Bersatu, not from the government. But in politics, timing is evidence. Acting days before nominations, and two days before a court hearing, hands the opposition exactly the grievance it wanted. This is not Cambodia. It is a self-inflicted wound for a government that promised reform. And there is a design flaw: the final appeal goes to the home minister, a cabinet politician. Decisions that can reshape an election should sit with the courts, and be settled fast.

What to watch: Thursday's High Court hearing, whether the coalition's parties agree a common logo before 31 October, and whether PAS and Barisan Nasional strike a deal for Melaka, which local media say they are discussing.
