Malaysia urged to speed up enforcement against errant maintenance payers

Authorities should accelerate efforts to pursue husbands who fail to pay court-ordered maintenance, particularly in cases where non-compliance stems from unwillingness rather than inability, a senior government official has indicated.

The deputy minister highlighted that existing enforcement mechanisms, currently applied within Islamic family law frameworks, should be adapted and strengthened across all communities. The push comes as cases emerge of individuals with sufficient financial means deliberately avoiding their maintenance responsibilities.

Current enforcement procedures have faced criticism for moving too slowly, leaving former wives and children in precarious financial situations. The official noted that when maintenance defaulters demonstrate capacity to pay yet continue non-compliance, swift intervention becomes essential.

The proposal suggests harmonising enforcement approaches across different legal jurisdictions within Malaysia's plural system, ensuring that vulnerable family members receive timely financial support. Officials are reportedly reviewing expedited mechanisms that could reduce delays in collection and enforcement procedures.

The matter reflects ongoing concerns about family law implementation and the protection of dependents' financial welfare across Malaysia's diverse population.
