Mississippi woman retains $1.2m farm after ex-husband's ownership claim rejected

The Mississippi Court of Appeals has upheld a lower court ruling classifying Butler Road Farm as non-marital property owned exclusively by Ellen Harrison, concluding that her ex-husband Wiley Harrison's challenge to the decision lacked sufficient legal grounds.
The farm, spanning 432 acres, was purchased by Ellen Harrison prior to her marriage to Wiley Harrison. Following their divorce proceedings, Wiley Harrison contested the classification, arguing that the property should be treated as a marital asset due to alleged financial connections between the farm and their family home, as well as his claimed contributions to the property.
In its decision, the appellate court examined the evidence presented by both parties and determined that Wiley Harrison had failed to establish a valid basis for claiming ownership rights. The court found that the pre-marital acquisition of the property was the decisive factor in maintaining its designation as non-marital assets, despite the financial entanglements cited by the ex-husband.
The ruling preserves Ellen Harrison's ownership of the property, valued at approximately $1.2 million, and reinforces the legal principle that assets acquired before marriage generally retain their character as separate property regardless of subsequent financial arrangements within the marriage.
