The High Court has dismissed a mother's claim to a stake in her daughter's home, despite the woman having contributed significantly to the property's purchase price. Judges ruled that the money provided—exceeding $1 million—constituted a loan to the daughter rather than a financial investment that would entitle the mother to an ownership interest in the residence.

The case centred on determining the nature of the financial arrangement between the two parties. The court examined evidence surrounding the transfer of funds and the intentions of both parties at the time of the property purchase.

In delivering its judgment, the High Court concluded that the circumstances of the transaction pointed to a lending arrangement rather than a co-ownership agreement or equitable interest. The mother's legal position was therefore confined to that of a creditor, should she choose to pursue recovery of the loaned amount through separate proceedings.

The ruling underscores the legal distinction between loans and investments in family property transactions. Without clear documentation or explicit agreement establishing ownership rights, contributions to property purchases may not automatically grant claimants legal title or equitable interests in the asset.
