NCAP should exempt motorists from penalties beyond their control, lawmaker argues

MANILA — The No Contact Apprehension Policy must be revised to shield motorists from penalties caused by factors outside their control, according to 1-Rider party-list Rep. Rodge Gutierrez.

Gutierrez cited concerns about the system's readiness for wider deployment, pointing to defective infrastructure, inadequate road signage, and deteriorating pavement conditions as variables that should not result in fines for drivers.

The lawmaker said the party-list organization has received feedback from the motoring public regarding fairness in the policy's implementation. Gutierrez emphasized that enforcement should be applied equitably, taking into account circumstances beyond individual driver responsibility.

The remarks highlight ongoing concerns about the NCAP framework as authorities prepare to reinstitute the automated traffic violation system. Road users have previously raised questions about enforcement standards and whether the technology accounts for environmental and infrastructural deficiencies affecting safe driving compliance.
