New e-commerce rules may strain small sellers with compliance burden

The Consumer Protection (E-Commerce) (Amendment) Rules, 2026, notified by the Department of Consumer Affairs, will supersede the 2020 regulations when it takes effect on January 1, 2027. The revised ruleset introduces several new obligations including mandatory disclosure of ranking parameters, transparent labelling of sponsored listings, price-history documentation for discount claims, alignment with dark pattern guidelines from 2023, and mandatory coordination with the National Consumer Helpline.

While industry executives and marketplace merchants acknowledge the government's intent to enhance consumer protection and transparency, they have flagged concerns that the expanded compliance requirements may impose disproportionate costs on small sellers and micro, small and medium enterprises (MSMEs). These sellers represent a significant portion of vendors operating on major e-commerce platforms across India.

Senior industry representatives have indicated that while the overarching objective of strengthening consumer safeguards is constructive, certain provisions warrant closer scrutiny regarding their practical impact on smaller merchants. The rules place particular emphasis on ranking disclosure mechanisms and price-history requirements, which stakeholders suggest may require substantial operational adjustments and resource investment from smaller businesses.

The regulatory shift reflects the government's broader push to create a more transparent and consumer-friendly e-commerce ecosystem. However, implementation challenges remain, particularly for smaller sellers who may lack the technical infrastructure and compliance capabilities of larger marketplace operators to meet the new standards within the stipulated timeframe.
