The Odisha High Court has dismissed Vedanta Resources' petition seeking bauxite supply at prices fixed under a 2004 agreement, citing the company's participation in a new procurement process established under amended regulations.

The court's ruling underscores a fundamental legal principle: parties cannot simultaneously benefit from updated policy frameworks while seeking to invoke terms from superseded agreements. Vedanta's involvement in the revised long-term linkage policy for bauxite procurement effectively precluded it from reverting to the earlier contractual terms, according to the bench.

The amended linkage policy was designed to modernise mineral allocation mechanisms in the state, establishing a transparent framework for future supply arrangements. By engaging with this new process, the mining company implicitly acknowledged the supersession of prior agreements and their pricing provisions.

The judgment reinforces that commercial entities must choose between old and new contractual frameworks when policy transitions occur. Vedanta's attempt to selectively apply terms from an outdated agreement while participating in its replacement was deemed legally untenable by the court.
