OSG urges budget freeze on 2026 funds pending SC ruling

Solicitor General Darlene Berberabe on Thursday recommended that the Department of Budget and Management and other executive agencies defer using specific 2026 budget funds pending the Supreme Court's final ruling on the matter.

"Our advice to DBM and the executive branch would be to hold off on using the funds for now," Berberabe said, citing the need for caution until the high court issues its definitive decision.

The recommendation reflects concerns that authorizing or disbursing the disputed budget allocations before the Supreme Court ruling could create financial and administrative complications if the court ultimately decides against their use.

The Supreme Court has been examining the contested budget provisions, with the case touching on broader questions of fiscal authority and appropriations procedures. The OSG's guidance suggests the government seeks to align its budget execution with judicial outcomes to avoid potential reversals or compliance issues.

The DBM and relevant agencies have not yet issued a formal response to the Solicitor General's advisory as of press time.
