Pennsylvania court clears way for truck stop drive-through after six-year legal battle

The Pennsylvania Commonwealth Court has delivered a significant victory to Jyotsna and Anil Jivani, ruling in October 2026 that their proposed drive-through window at their convenience store constitutes a legitimate business extension. The court's decision reverses a lower court verdict and provides final approval for the couple to move forward with construction.

The Jivanis initially submitted their drive-through proposal in 2020, but township officials rejected the plan. The ensuing legal challenge saw the case move through multiple court proceedings over the following years, with the lower court initially siding with the township's position.

The Commonwealth Court's ruling affirmed that a drive-through window represents a natural extension of the couple's existing convenience store operations at their truck stop location. Judges determined that the township's initial objections did not constitute sufficient grounds to deny the permit.

The decision brings closure to one of the couple's longest administrative battles and clears the pathway for them to implement the expansion project they envisioned more than six years ago. Construction approval can now proceed based on the court's final judgment.
