Pesticide industry pushes for stricter online sales rules, data protection

CropLife India, the industry body representing pesticide manufacturers, has advocated for tighter regulatory frameworks governing the online sale of crop protection products, arguing that e-commerce platforms should comply with conventional market regulations.

The organisation is also pressing for a five-year data exclusivity period for information generated during the product approval process in India. This protection would shield proprietary research and development details submitted to regulatory authorities from disclosure or use by competitors.

The dual push reflects growing concerns within the pesticide industry about unregulated online sales channels and the need for consistent enforcement standards across distribution networks. Digital platforms have emerged as significant retail channels for agricultural inputs in recent years, yet operate with varying degrees of regulatory oversight compared to brick-and-mortar dealers.

Data protection provisions are common in pharmaceutical and agrochemical sectors globally, with companies arguing that extended confidentiality periods incentivise innovation and justify substantial investment in developing new formulations and solutions. The industry contends that India's current framework requires clarification to ensure data generated during approvals receives adequate legal protection.

The proposals will likely be considered by India's regulatory authorities as they refine policies governing agricultural input sales and intellectual property protection in the crop protection sector.
